1. Acceptance of Terms

By downloading, installing, accessing, or using the ScamCheck mobile application (the “App”) and website located at https://www.scamcheck.com (the “Website”), you agree to be bound by these Terms and Conditions (the “Agreement”). If you do not agree to these terms, you may not use the App or Website.
ScamCheck (“we,” “us,” “our,” or “Company”) reserves the right to modify these Terms and Conditions at any time. Your continued use of the App or Website following the posting of revised Terms and Conditions means you accept and agree to the changes.

2. License and Use
2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and Website for personal, non-commercial purposes in accordance with these Terms and Conditions.

2.2 Permitted Use

You may use the App and Website to:

  • Scan text, emails, URLs, and images for potential scam indicators
  • View your scan history and threat analysis results
  • Access threat intelligence and security tips
  • Create and manage your account
  • Contact customer support

2.3 Prohibited Use

You agree NOT to:

  • Use the App or Website for any illegal purpose or in violation of any applicable laws
  • Attempt to hack, crack, or gain unauthorized access to the App, Website, or our systems
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to develop competing products or services
  • Transmit malware, viruses, or harmful code
  • Spam, harass, or abuse other users
  • Collect or scrape data from the App or Website without authorization
  • Circumvent security measures or access controls
  • Use the App for commercial purposes without written permission
  • Impersonate any person or entity
  • Interfere with the proper functioning of the App or Website

3. Intellectual Property Rights
3.1 Ownership

All content, features, and functionality of the App and Website, including but not limited to:

  • Software code and algorithms
  • Threat detection models and patterns
  • User interface design
  • Text, graphics, logos, and images
  • Threat intelligence databases

are owned by ScamCheck, our licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

3.2 User Content

Any content you submit to the App or Website (including scan history, feedback, or messages) is owned by you. However, by submitting content, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and distribute your content for the purpose of improving the App and providing services.

3.3 Limited Use of Intellectual Property

You may not:

  • Reproduce, modify, or create derivative works of the App or Website
  • Use our trademarks, logos, or brand names without written permission
  • Remove or alter any copyright, trademark, or other proprietary notices

4. User Accounts
4.1 Account Creation

To use certain features of the App, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4.2 Apple Sign-In

You may authenticate using Apple Sign-In. By doing so, you authorize us to access your Apple ID information as provided by Apple’s authentication service. You are responsible for maintaining the security of your Apple ID.

4.3 Account Termination

We may terminate or suspend your account at any time, with or without cause, and without prior notice if:

  • You violate these Terms and Conditions
  • You engage in illegal or harmful activity
  • We discontinue the App or service
  • Required by law

5. Disclaimer of Warranties
5.1 “As-Is” Provision

THE APP AND WEBSITE ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP OR WEBSITE, INCLUDING:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of content
  • Uninterrupted or error-free operation

5.2 Threat Detection Accuracy

While we strive to provide accurate threat detection, we do not guarantee that the App will detect all scams or threats. The App is a tool to assist you in identifying potential threats, but it should not be your sole reliance for security decisions. Always exercise caution and use multiple sources of information when evaluating potential threats.

5.3 Third-Party Content

We are not responsible for:

  • Third-party websites, services, or content linked from the App
  • Accuracy or reliability of third-party information
  • Actions or omissions of third parties

6. Limitation of Liability
6.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCAMCHECK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the App or Website
  • Damages arising from unauthorized access to your account
  • Damages from viruses or malicious code

6.2 Cap on Liability

Our total liability to you for any claim arising out of or relating to these Terms and Conditions or the App shall not exceed the amount you paid for the App in the past 12 months (or $0 if you have not paid anything).

6.3 Applicable Law Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are in such a jurisdiction, the above limitations may not apply to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless ScamCheck, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the App or Website
  • Your violation of these Terms and Conditions
  • Your violation of any applicable law or regulation
  • Your infringement of any third-party rights
  • Any content you submit or transmit

8. Termination
8.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. Upon uninstallation, all your local scan history will be deleted.

8.2 Termination by Us

We may terminate or suspend your access to the App or Website at any time, with or without cause, and without prior notice or liability.

8.3 Effect of Termination

Upon termination:

  • Your license to use the App terminates
  • You must cease all use of the App and Website
  • Provisions that should survive termination (including Limitation of Liability, Indemnification, and Governing Law) shall remain in effect

9. Governing Law and Dispute Resolution
9.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of laws principles.

9.2 Arbitration

Any dispute arising out of or relating to these Terms and Conditions or the App shall be resolved by binding arbitration in accordance with the American Arbitration Association (AAA) rules, rather than in court. The arbitration shall be conducted in the location of your country.

9.3 Exceptions to Arbitration

Notwithstanding the above, the following matters are not subject to arbitration:

  • Claims for injunctive or equitable relief
  • Claims arising from intellectual property infringement
  • Claims brought by either party in small claims court

9.4 Class Action Waiver

You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative action.

10. Privacy

Your use of the App and Website is also governed by our Privacy Policy located at https://www.scamcheck.com/privacy-policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

11. Modifications to the App

We reserve the right to:

  • Modify, update, or discontinue the App or Website at any time
  • Add, remove, or change features or functionality
  • Impose limits on certain features or services
  • Restrict access to parts of or all of the App or Website

We will attempt to provide notice of material changes, but we are not obligated to do so.

12. Third-Party Links and Services

The App and Website may contain links to third-party websites and services. We are not responsible for:

  • The availability or accuracy of third-party content
  • The privacy practices of third parties
  • Your use of third-party services
  • Any transactions or interactions with third parties

Your use of third-party services is subject to their terms and conditions and privacy policies.

13. Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas about the App or Website, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and distribute your feedback without any obligation to you.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and ScamCheck regarding the App and Website and supersede all prior agreements and understandings.
